Commissions and contracts
-
All work must be offered by a person with the authority to do so.
-
All agreements must be confirmed promptly in writing, by email. An oral agreement is also a
contract and must be confirmed in writing (as above) - if it is not, it shall be deemed that no such agreement has been made.
-
As soon as work has been agreed, and terms and fees accepted, it shall be deemed a contract
with the client. Details of the brief, agreed fees/expenses, agreed delivery date, and the rights licensed to the client to
use the work will have been established before the contract is agreed.
-
Later changes to the brief may result in a change of fees.
-
Once agreement has been reached, the client will be expected to sign
and return a Confirmation of Commission form to ensure the terms (on both sides) are perfectly clear. This form is a legally
binding document, and is approved by the Creators’ Rights Alliance.
Payment
-
For individual clients, a deposit of 50%
of the full fee is payable in advance, with the balance becoming due within 30 days of being invoiced.
-
For corporate clients, an invoice will accompany
the completed work. Payment
is due within 30 days of the submitted invoice.
-
Overdue payment will incur interest at 5% per month from the date of
the original invoice, irrespective of whether the client is an individual or a company.
-
The client is responsible for any fees arising from returned cheques
or reversed transfers.
-
Payment may be made by BACS or a cheque drawn on a UK bank account, or
by Paypal. If using the latter, the client shall be responsible for all fees - these will be added to the invoice.
-
Bulk mailings (such as for returning manuscripts) are charged at
cost and must be paid for in advance.
Miscellaneous
-
Proofing & Editing cannot be held responsible for the use and content
of any submitted document. It is the client's responsibily to ensure that no plagiarism or breach of copyright has taken place.
-
Proofing & Editing will keep client files on record for a period
of 18 months. This should not be viewed as an alternative to clients creating and keeping their own back-ups.
-
Proofing & Editing takes client confidentiality very seriously, and
is more than happy to sign non-disclosure agreements (NDAs) as and when necessary.
